This website presents the You, Me, Baby program developed by Sylvana M. Côté and her team at CHU-Sainte-Justine with the support of the Fondation du CHU-Sainte-Justine. The provincial upgrade was carried out in collaboration with the Centre d’expertise en technologies de l’information, santé mentale, dépendance et itinérance (CETI-SMDI) (“we“).
You, Me, Baby was created for pregnant women in Quebec, as well as for their partners and healthcare professionals interested in perinatal mental health, and for anyone else interested in this website (“you“).
The goal of You, Me, Baby is to offer a prenatal mental health course. You, Me, Baby is an intervention program designed to prevent postpartum depression in pregnant women with mild to moderate symptoms of anxiety and depression.
Use of You, Me, Baby is subject to these Terms of Use and the Privacy Policy. The use of You, Me, Baby and its content, you acknowledge that you are a user and that you have read, understood and accepted these conditions.
1. RIGHTS OF USE OF YOU, ME, BABY AND ITS CONTENTS
1.1
Access and use rights. You, Me, Baby and its contents are provided to enable you to:
- Equip you and, if necessary, your partner or healthcare professional to deal effectively with the emotional issues that arise during the perinatal period.
- Support your mental health and the well-being of your newborn child.
These two points constitute the permitted use of You, Me, Baby and its content (“permitted uses“).
An account is needed to access You, Me, Baby and its content.
1.2
Obligations. The rights of access and use are to ensure that:
- 1.2.1 The use of You, Me, Baby and its content is for permitted use only;
- 1.2.2 The use of You, Me, Baby and its content is for personal use only;
- 1.2.3 The access to You, Me, Baby and content is only through the usual servers;
- 1.2.4 Users do not download viruses, Trojans or other malicious code;
- 1.2.5 Users do not use You, Me, Baby or its content to harass, abuse, stalk, threaten or otherwise prejudice any person;
- 1.2.6 Users do not do any of the following: (i) transfer, create, sell, loan, lease, sublicense, assign, adapt or make any other unauthorized use of the rights granted to you; (ii) grant any rights to You, Me, Baby and its content; (iii) copy, change, disassemble, decompile, derive, modify or extract any source code; or (iv) use or exploit You, Me, Baby and its content to harm or burden its capacity.
2. NO FEES
2.1
You, Me, Baby and its contents. The use of You, Me, Baby and its content is free and without charge.
2.2
Device use. We cannot be responsible for any data usage charges that may apply according to your internet and/or mobile network provider as a result of using our site.
3. OWNERSHIP OF YOU, ME, BABY AND ITS CONTENTS
3.1
Our ownership rights. You acknowledge and understand that:
- 3.1.1 You, Me, Baby (including its features and functions) and its content are our property;
- 3.1.2 You may refer to You, Me, Baby and its content, or include a link as long as it is done for the permitted uses;
- 3.1.3 You must preserve any “©” symbol or other copyright symbol (or other intellectual property right) found on You, Me, Baby or its content;
- 3.1.4 You are not allowed to use our trademarks, logos, other symbols and names without our prior written consent.
3.2
Communication. If you are aware of any unauthorized use of You, Me, Baby or its content, or if you have reasonable grounds to suspect such use, you must immediately contact us at the following e-mail address: info@toimoibebe.ca.
4. LIABILITY AND LIMITS
4.1
Liability. You are responsible for the use you make of You, Me, Baby or its content, and for any damage caused to your device as a result of such use.
4.2
Limits of liability. Although we use appropriate technology, You, Me, Baby and its content – like all technology – is not infallible or immune to unforeseeable events. Furthermore, You, Me, Baby and its content were not created to meet the specific needs of certain users or to provide a list of all available means to prevent postpartum depression and all other mental health issues. Finally, You, Me, Baby and its content are provided solely for educational, informational and self-care purposes. You, Me, Baby does not provide advice, replace the help, care or diagnosis a health professional may offer, or replace the help provided by any other emergency service.
Subject to applicable law, we make no representations or warranties in connection with (a) the use and fitness for a particular purpose of You, Me, Baby or its content; (b) the uninterrupted, continuous and bug-free use; (c) the availability at any time and without delay of the Website; (d) compliance, other than as provided in these Terms of Use; and (e) the intellectual property rights related thereto.
5. AND FINALLY
5.1
Beginning. These terms of use apply from the moment you visit this website and/or consult You, Me, Baby or its content.
End. These terms of use apply until the end of the user session that allows you to browse the website. We may also terminate You, Me, Baby or its content. In such a case, we will act in accordance with applicable laws.
5.2
Right to suspend some access. Instead of terminating You, Me, Baby and its content, we may limit, restrict or suspend your use or access of You, Me, Baby for the time necessary to deal with a situation (e.g. a defect, bug or virus). In addition, access to You, Me, Baby may be unilaterally denied in the event of non-compliance with these conditions of use.
6. PERSONAL INFORMATION
The sharing of personal information (last name, first name, e-mail address) may be required to create a user account for the You, Me, Baby program, to improve your experience or to enhance the effectiveness of the You, Me, Baby intervention program. The personal information collected, used, communicated and retained, as well as your rights arising from it, are identified and explained in the Privacy Policy. Finally, no advertising will be broadcast on You, Me, Baby.

You, Me, Baby and its content include links to other third-party support resources. These inks are provided for information purposes, among others, to facilitate your access to more mental health support. However, we remind you that:
- We have no control over these resources;
- We do not systematically validate their content and accessibility;

8. OTHER TERMS
8.1
Complete Agreement. The Terms of Use constitute, with the Privacy Policy, the set of rules applicable to your use of You, Me, Baby and its content. Please note that the Terms of Use and Privacy Policy can be downloaded from the You, Me, Baby Website.
8.2
The conditions of use may be changed. Changes will be notified to you in advance. We will assume that you accept those changes if you access or continue to use You, Me, Baby or its content. If you do not agree to the changes, you must stop using You, Me, Baby before the changes take effect.
8.3
Applicable laws and disputes. You, Me, Baby, its content and conditions of use are governed by the laws in force in Quebec, to the exclusion of any principle that may lead to the application of foreign laws. Any dispute shall be submitted to the courts of the Province of Quebec (judicial district of Montreal), which shall have sole jurisdiction to settle it.
